NASA lawyers
have initiated the process of filing suits against five senior IEBC officials
who ‘defraud’ the August 8 general election.
The lawyers
James Orengo (Siaya Senator), Otiende Amolo (Rarieda MP), Pheroz Nowrojee,
Peter Kaluma (Homa Bay Town MP), Paul Mwangi, Okong’o Omogeni (Nyamira Senator)
and Norman Magaya (NASA chief ex- ecutive offi cer) will file the suit after
successfully
challenging the reelection of President Uhuru Kenyatta.
They
want the officials, including the IEBC CEO Ezra Chiloba, jailed for contempt of
court after failing to obey the Supreme Court orders to allow NASA to
scrutinise election transmission gadgets and servers.
Amolo, in
an interview with a local TV station, said plans to sue the officials is
underway.
The
other IEBC officials to be sued are Betty Nyabuto (head of operations), James
Muhati (ICT director), Immaculate Kassait (voter registration and election
operations) and Paraxedes Tororey (legal and public aff airs director).
The
court ordered the IEBC to allow the Judiciary’s information and technology
experts, NASA and Jubilee lawyers to scrutinise the election management systems.
It didn’t fully comply.
The IEBC
did not also provide scanned and transmitted copies of all forms 34A and 34B as
ordered by the court.
“Court
orders are only meaningful if they are fully obeyed,” Kaluma said.
